Rural is Better!

The EB-5 Reform and Integrity Act of 2022 created new three new EB-5 visa subcategories and a new I-526E petition form. Investors in an EB-5 project located in a rural area, like the Apple Mountain KY LP project, now hold several distinct advantages during their immigration process.

Priority Processing and Adjudication: By law the USCIS must prioritize processing and adjudication of  I-526E petitions for projects located in a rural area.  USCIS has announced new case processing goals and will factor in the case type when deciding how to prioritize processing and adjudications of I-526E petitions. In 2024, I-526E petitions in rural areas were beginning approved within 8 and 14 months.

Lower Investment Amount: Rural based EB-5 projects require the lowest possible investment amount, which is currently $800,000.

No Per-Country Waiting Queues: Because the rural/high unemployment/infrastructure visa allocation categories are new, they currently have no waiting queues. This provides a massive advantage for Chinese and Indian born immigrant investors.  20% of EB-5 visas are allocated to rural projects, meanings there are just a few thousand rural EB-5 visas available. You and your family can move to the United States of America faster with a rural EB-5 project investment.

Rural Approved: The USCIS has approved the West Virginia Regional Center’s I-956F application for a New Commercial Enterprise (NCE) on July 31, 2024.  The letter further states that the Job Creating Entity (JCE) is doing business within a rural area. Copy of our approval letter is available upon request.
